Requirements Five members, appointed for three year terms which expire on January 1; if vacancy occurs municipality appoints for unexpired term; must be a freeholder and resident of city, three fifths of board must have been residents for at least ten years prior to appointment; no member shall be a member of the Planning Commission nor shall member hold other elective or appointive office in the city. A chairman and a vice chairman shall be elected from membership. Sec. 91-1. Zoning ordinance.
There is hereby adopted that certain revised document heretofore published by the City and which is entitled " ZONING ORDINANCE of the CITY OF CHARLSTON, WEST VIRGINIA, as passed by Ordinance No. 2924, March 7, 1983, as amended", as revised by the Council of the City of Charleston, and kept on file in the planning department, city hall, where it shall be available to the public for inspection and use during all regular business hours; and said document, as revised, is hereby incorporated herein and made a part thereof as fully as though set out in length; and the provisions of said document, as revised by council for the City of Charleston from time to time, shall be controlling within the city limits of the City of Charleston in all matters related to its subject matter. It is unlawful for any person to act in any way or manner contrary to the provisions therein. (Bill No. 7047, 4-19-2004) Note: The purpose of this bill is to correct an editing error which occurred during the re-codification. It was not the intent of the Council for the City of Charleston to include Appendix B verbatim within the text of the codification; but rather to have the zoning ordinance adopted by reference by the code. This Chapter is new; therefore, strike-throughs and underscoring have been omitted.
